Colebrook CSC & Transporters Terms and Conditions
These terms and conditions on which we supply any provision of service or goods from Colebrook Car service Centre & Transporters Ltd to the customer.
Please read these terms and conditions carefully.
Definitions:
“The Garage” means us, Colebrook CSC & Transporters Ltd, 32-34 Valley Road, Plympton, Plymouth, PL71RF.
“The Customer” means you, any individual, firm or corporate body requiring the services of Colebrook CSC & Transporters Ltd.
Work” means any services carried out by the Garage, including but not limited to repairs, vehicle servicing and MOTs and Vehicle Conversions.
“Vehicle” means the Customer’s vehicle which may be a car, van, motorhome, motorcycle, caravan or trailer.
These terms and conditions will be binding between the Garage and the Customer upon the booking of any work.
Appointments
We offer a free consultation to get to know you & what requirements you are looking for in your Campervan Conversion. These are by appointment only.
Estimates
The prices, quantities & delivery times stated in any estimate are not binding on the Company. They are commercial estimates only which the Company will make reasonable efforts to achieve.
We reserve the right to change the build specification and prices subject to increase by suppliers of materials/parts used. This also includes any price increase from any third-party companies.
We reserve the right to increase a quoted fee after work has begun in the event you request a variation to the work quoted which requires different or additional labour and or parts.
Any extra labour required due to any unforeseen complications with your vehicle, will be charged accordingly.
Deposit and Refunds
10 % booking deposit is required to secure the workshop slot for conversions. The booking deposit is nonrefundable.
The commencement date for your Campervan Conversion, is not fixed, if we get ahead on previous builds this date may be brought forward. Subsequently due to any unforeseen circumstances that may be out of our control this build slot may be delayed. We will always keep you informed of any changes to your build date & give you reasonable notice.
50% deposit for parts and materials to be paid at least 28 days before works are to commence.
By accepting the quote or estimate and paying a deposit you have entered into a contract. If you cancel the contract with us before the build starts or at any other stage of the build any monies paid will be subject to deductions for time and costs incurred plus parts, materials or third-party services already purchased for your project before any amounts are refunded.
Please note that a significant amount of time and costs can be incurred before your van arrives on site. We also reserve the right to recover lost earnings as a result of being unable to fill your booking slot with another customer project.
If work is cancelled once the Booking has been confirmed, we will need to charge a parts restocking fee which will be deducted from the 50 % deposit before any amounts are refunded.
If any items are changed After 50% deposit has been paid and before work has started, we may need to charge parts restocking fee and alter Estimated costs to cover Parts, Materials and labour needed to carry out alterations.
Your Vehicle
Before bringing your vehicle to the garage, please ensure that the interior is as empty as possible. All personal belongings should be removed, and any cupboards or storage areas should be cleared to allow easy access for our team.
Vehicles are subject to a thorough check in process on drop off which includes taking photos and videos. Prior to leaving our premises your vehicle will be quality checked which will be signed off by you on collection.
We will need to drive your vehicle while it is in our care. This is usually limited to moving it in and out of our workshop, but can also extend to road tests or, in rare cases, transfer to one of our suppliers where some of the work may be carried out. Our parking is very limited and vehicles take up a lot of space, so once we’ve completed your build, we will ask you to collect your vehicle as soon as is reasonably possible. On occasions due to parking being limited, if our separate offsite parking which is in a locked compound is full, we may have to park your vehicle on the road. We cannot be held responsible for any damage or theft of your vehicle.
If you are having a Diesel heater fitted, then please ensure you bring your vehicle to us with the fuel tank just under half full. This is for health & safety reasons, due to the fact that the fuel tank will need to be lowered from your vehicle & the weight cannot exceed the recommended guidelines. If the fuel tank is over, the customer may incur extra labour costs.
We reserve the right to use images of the build process on your vehicle & your completed Campervan on our social media, marketing campaigns & website. If you would rather have no images of your campervan appeared on any of these platforms, then please confirm this to us in writing prior to your vehicle arriving in our workshop.
Colebrook CSC & Transporters Ltd accepts no responsibility and cannot be held liable for any extra work resulting from the discovery of previous poor repairs or age/ rust related damage to the vehicle. All discoveries will be notified to the customer and priced accordingly. It is then up to the customer to decide the course of action with the vehicle.
Carrying out the work
Prior to the work commencing please advise us of any parts that come off your vehicle that you may want retaining. If there are any parts you do want retaining, you will need to arrange collection of these parts asap, as we will be unable to store them in our workshop.
We ask that you deliver your vehicle to us at the agreed time, so we can commence your build. Please be advised that if your vehicle is delivered to us late, we may be unable to complete your Campervan Conversion in the time originally specified.
We cannot be held responsible for any damages or breakages that we may find to your vehicle whilst we are building your Campervan Conversion, as we do not know the current condition of your vehicle until the build commences.
Due to the nature of the work to be carried out it is possible that some collateral damage may occur during the project. For example, some vehicle clips and fixings are designed to be single-use and others may just break when being removed. Similarly, sometimes removing or disconnecting parts or systems cause them to fail. One of the most common types of collateral damage is damaged, poor quality or ageing paint peeling off. Many tasks will require areas of your vehicle to be masked using tape and, although we use specialist automotive masking tape, this still can pull off paint that is in poor condition. When we assess your vehicle prior to the build we will endeavour to make you aware of the risks. However, should any such damage occur during the build we will contact you with any options to rectify this at an additional cost to you.
Very occasionally, our suppliers will change their prices without notice. In the event this happens we’ll always notify you as soon as we’re aware and offer the option to continue with the purchase of the item at the new price or to consider alternative products.
While every effort is made to ensure that the items quoted and supplied match exactly, occasional substitutions are made by our suppliers where products are updated or superseded. We’ll also occasionally substitute equivalent items where those quoted are out of stock. Where the substitution is noticeable in some way, and either changes the look or functionality of the design, we’ll discuss this with you.
From time to time, items will be out of stock with our suppliers or their delivery to us may be held up. This may cause a delay in your build and we may need to select an alternative product. Lead times increase at short notice and during busy season can double. We will endeavour to keep you informed of any delays.
All dates agreed are estimates only. Every vehicle and their modifications are different so, by the nature of our work, we sometimes run behind due to unforeseen circumstances. We work hard to minimise any resulting delays but it is not always possible to completely eliminate them. We strongly advise you do not book ferries, holidays or campsites close to your expected Campervan Conversion completion date until you have confirmation of that date. We will not be liable for any further charges or costs incurred as a result of any delays. This includes booking of ferries, holidays & campsites.
We will Advise of any increased costs at the time to gain authorisation.
Labour will be reduced if works are completed under the estimated hours.
Customer supplied parts
On occasion we’ll fit parts supplied by the customer. This is at your own risk and we are not liable for any failure of these parts during or after fitting.
Often parts can be of lower quality than we would normally supply and fit, or may not be the correct part for your van. If this happens and we need to change the part or spend additional time making it fit for purpose in your van you would incur additional costs. This would be agreed with you ahead of doing the work. Should such parts cause any damage to the Vehicle, we shall be entitled to charge for any costs incurred, including any labour for their installation and / or removal, and will not be held responsible for any consequential loss or damage whatsoever.
Handover
All appliance information booklets, certificates and instructions will be together in a folder which will be passed to you on day of handover. It is your responsibility to read and understand this information.
During your handover, we will talk you through all the work that has been completed during your Conversion & the operational & safety procedures relevant to your Campervan Conversion. We understand it may be difficult to remember all the information we tell, so if you are ever unsure, please give us a call. If this is your first Campervan, please advise us & we will spend some extra time with you on your handover.
Colebrook CSC & Transporters LTD cannot be held responsible for any damage to your vehicle through the inability to operate or misuse.
Warranty
We make every effort to ensure all services are of the best quality, however occasionally faulty items are supplied in error. Any faulty items must be reported as soon as possible. Customers will need to be prepared to return the vehicle to Colebrook Transporters Ltd for any repairs to be carried out.
We make every effort to carry out repairs promptly.
The Warranty does not include damage caused by misuse or poor maintenance.
The Warranty also does not include second hand or used items.
Colebrook CSC & Transporters LTD reserves the right to investigate the circumstances surrounding any conversion defects, as some defects may arise due to the maintenance, care, and/or storage of the vehicle. Additionally, the company reserves the right to use its discretion in determining whether to grant work under warranty.
Colebrook CSC & Transporters LTD also reserves the right to refuse warranty work if work carried out by others is seen to be sub-standard or the cause of the defects.
Charges & Payments
Payments can be made in the following ways:
• Bank Transfer
• Debit or Credit Card
For payments made in person we have a card payment terminal on site.
For remote payments we’ll send you an email with Colebrook CSC & Transporters Ltd bank details.
We ask if payment is made via BACS to let us know as soon as it has been sent so we can confirm receipt our end.
All goods shall remain the property of the seller until paid for in full. Payment is made in UK pound sterling via bank transfer or card payment on collection. The vehicle will not be released until full payment has been received.
For garage bookings, any special order parts ordered in advance must be paid for in full prior to ordering and shall be non-returnable or refundable in any circumstances. Such parts may also be subject to a handling charge and this will be advised to the Customer in advance of any orders being placed.
For conversion bookings, final payment will include the final 40% of the total estimated cost plus any extras
Where the customer fails to pay any charges, or breaches the contract in any way, we will be entitled to (without prejudicing, losing, or reducing any other right or remedy) suspend the work/repair process, or hold the vehicle until full payment is made. The completed vehicle will not leave our premises until the customer’s account has been settled.
Risk of loss
The risk of loss or damage to the Goods shall pass to the customer upon collection of your vehicle. Please inspect your vehicle thoroughly before you drive it away, we will not be held responsible for any damage reported after the vehicle has left our premises.
Limitation of liability
The customer shall fully indemnify the Company against any liability to third parties arising out of the customer’s use of goods.
Indemnity
The customer hereby agrees to indemnify and keep indemnified Us, our employees & contractors & hold us, our employees & contractors from & against any breach of non observance by the customer of these conditions & any claim bought against us by a third party resulting in the provision of services by us to the customer, the customer’s use of services & the server & the customer’s materials placed on the website including, without limitation, all claims, actions, proceedings, losses, liabilities, damages, costs, expenses (including reasonable legal costs & expenses) howsoever suffered or incurred by us as a consequence of such breach or non-observation.
Force Majeure
We shall not be held liable for any breach of contract or for any delay or failure to perform our obligations under these terms due to events or circumstances beyond our reasonable control. Such events include, but are not limited to;
- Labour disputes (strikes, lockouts, industrial actions)
- Civil unrest (riots, threat or preparation of war, war, invasions, or political interference)
- Natural disasters (storms, floods, earthquakes, fires, epidemics or other natural physical disaster)
- Transport disruptions (issues with railways, shipping, aircraft, motor transport or other means of public transport)
- Political interference with our normal operations.
Severance
Each paragraph of these Terms & Conditions operates separately. If any court or relevant authority decides that any of them is unlawful or unenforceable, the remaining paragraphs will remain in full force & effect.
Complaints
Should you have any complaints about the service you received from us, then please contact us, we will endeavour to resolve any issues as soon as possible.
Governing Law
The Agreement, incorporating these Terms & Conditions, & any matter arising from or in connection with it shall be governed by & construed in accordance with the English law, and the customer hereby submits to the exclusive jurisdiction of the English courts.
Abuse
We will not tolerate any abusive behaviour, language or threats to any staff or other customers, whether in person, on the telephone or in writing. Anyone engaging in such behaviour on our premises will be asked to leave immediately. If necessary, we will contact the police to ensure the safety and well-being of our staff and customers.
Data Protection
We will retain your details and hold them on a secure database for the purpose of direct marketing. If you wish to be removed from our database, please write to us to let us know.
We will not share your personal data with any third parties for any reasons without your prior consent. Such data will only be collected, processed and held in accordance with our rights and obligations arising under the provisions and principles of the Data Protection Act 1998.
We have the right to pass on any personal information provided by the Customer to relevant authorities including, but not limited to, the DVLA and the police. In the event that the Customer is in breach of these Terms and Conditions, we may also pass on any such information to credit reference agencies and debt recovery agencies.
